Renfe will maintain a minimum service of 75% for the strike in the next few days | Economy

The National Court has lowered this Wednesday the minimum services established by the Ministry of Transport for the Renfe strike. The stop, called for this Friday and on October 1, 4 and 5, will have minimum services of 65% and 72% in medium and long distance trains, as well as 24 in goods.

However, the Contentious-Administrative Chamber of the court has considered that maintaining minimum services in the vicinity of 100% at rush hour and 75% the rest of the day is an excess on the part of the administration. Therefore, the room has lowered them to 75 and 50% respectively.

The Chamber thus resolves the very precautionary measure requested by the Spanish Union of Train Drivers and Railway Helpers (SEMAF). The court understands that the establishment of minimum services of 100% implies “a serious impediment to the right to strike for workers engaged in such service, lacking proportionality, and there are alternative means of transport.”

For the judges, since commuter transport is essential, minimum services must be established. SEMAF, indicates the car, proposes a percentage of 75% for peak hours and 50% for off-peak hours. “This percentage is reasonable because it allows the exercise of the right to strike and ensure commuter transport to users, also coinciding with the percentages set in previous calls for strikes by the Administration itself,” he concludes.
