After I published the legal tip on Robert Kneschke’s approach in August 2020, I was approached by a few other alleged violators of Robert Kneschke’s image rights.
1. The procedure
Mr. Kneschke also regularly wrote to his opponents in the other cases, initially without commissioning his lawyer. Were the required € 450.00 plus VAT. not paid, but then Mr Kneschke turned on lawyer Deubelli.
In addition to the submission of a declaration of cease and desist with criminal penalties, he now demanded damages of € 1,044.00 gross and legal fees of € 710.85 gross.
Most of the pictures were about graphic children’s drawings from a whole series of pictures to which Mr Kneschke apparently owns the rights.
2. Legal tips
Do not contact Mr. Kneschke or Mr. Deubelli until you have obtained advice from a lawyer. Ideally, you should contact a lawyer before Mr Kneschke even calls on his lawyer. Likewise, do not submit the requested cease and desist declaration without prior verification by a lawyer and do not pay the required amount for the time being without having this legally verified.
