What is the role of a Users’ Commission?
A users’ commission (CDU) is set up in each public or private health establishment as well as in inter-hospital unions and health cooperation groups authorized to carry out the missions of a health establishment.
This commission ensures that users’ rights are respected, facilitates procedures and contributes, through its opinions and proposals, to improving the policy for the reception and care of sick people and their relatives.
Composition of the Users’ Commission:
The CDUs are composed of:
- the legal representative of the establishment or the person he appoints for this purpose;
- a medical mediator and his deputyappointed by the legal representative of the establishment;
- a non-physician mediator and his substituteappointed by the legal representative of the establishment;
- two user representatives and their alternates, mandated by an approved association and appointed by the Director General of the ARS (in accordance with the first paragraph of Articles R. 1112-81 to R. 1112-84 of the Public Health Code (CSP).
Any other members defined in II to VI of article R.1112-81 of the public health code:
- the president of the establishment’s medical committee or the representative he appoints from among the doctors who are members of this commission;
- a representative of the nursing, rehabilitation and medico-technical care commission and his deputy ;
- a staff representative and his deputy;
- a representative of the supervisory board and his deputy.
Characteristics of RU’s mandate in the CDU:
The representatives of the designated users are appointed by an association approved at the regional level or, failing that, at the national level, in accordance with article L.1114-1 of the Public Health Code.
The mandates of the members of the CDU are of three years renewable (provided for by R.1112-85 of the CSP).
The chairmanship or vice-chairmanship of the CDU may be provided by a user representative.
The members of the commission are compensated for travel expenses incurred as part of their missions.
