Regional Labor Court negotiates collective bargaining agreement at Bahn – Berlin.de

Despite the collective bargaining agreement between Deutsche Bahn and the Union of German Locomotive Drivers (GDL) last week, an important aspect of the conflict is currently preoccupying the Berlin State Labor Court: In which of the around 300 companies in the group are the GDL’s collective agreements actually applied? The background to this question is the Unified Collective Bargaining Act. It stipulates that in a company with two unions, only the collective agreement of the employee representatives with a larger number of members will be applied.

On the railways, the GDL competes with the Railway and Transport Union (EVG) for members. From the group’s point of view, EVG has the majority in most railway companies, GDL only in 16. The union doubts this and even before the most recent collective agreement, it sought several urgent proceedings against this determination. In both Berlin and Frankfurt, however, the competent courts rejected the GDL’s applications. The main proceedings are now pending in Berlin.

The collective agreement reached last week stipulates that the majority ratios in the railway companies should now be determined by a notary. The union will continue to pursue the ongoing lawsuits, GDL boss Claus Weselsky announced.
