Region of Western Greece: The new reality through the merger of FoDSA – 2024-09-02 00:31:36

The new article 226E, which is added to the aforementioned law, provides for the merger of the existing solid waste management bodies into a single scheme with spatial competence throughout the Region.

The amendment of the law through the addition of article 226E marks a new era in solid waste management in the Region of Western Greece. By merging the existing agencies into a single Agency, it is expected to achieve greater efficiency, improved administrative structure and better management of financial and human resources. The success of the new structure will depend on the consistent implementation of the prescribed procedures and the cooperation of all the agencies and personnel involved.

The Merger Structure

According to article 226E, the legal entities under public law with the name “UNITED ASSOCIATION OF SOLID WASTE MANAGEMENT P.E. AETOLOKARNANIAS” and “ILIA PROVINCE WASTE MANAGEMENT ASSOCIATION” are compulsorily merged into the legal entity “Achaia PROVINCE SOLID WASTE MANAGEMENT ASSOCIATION”, which is renamed “Western Greece Region Solid Waste Management Agency” (Fo.D.S.A. Western Greece ). The seat of the new body will be in the Municipality of Patreon, while its territorial competence will cover all the municipalities of the region.

Merger Steps and Next Actions

The merger process provides for specific steps and strict deadlines for the completion of the procedures. Before the full integration, the existing Associations will continue to perform their duties and will take the necessary measures for the smooth transition of their functions to the new entity. For a smooth transition, a three-member committee will be created to record the assets of the merging Associations. This committee will be made up of a representative of the Decentralized Administration of Peloponnese, Western Greece and Ionia, the presidents of the Associations to be merged and the president of SY.D.I.S.A. N. Achaia.

In the event that the committee cannot complete its work, certified auditors – accountants or an auditing firm are appointed to register the assets. The process is completed within a strict deadline, with the final report sent to the Secretary of Decentralized Administration, who issues the merger decision.

Financial and Administrative Implications

With the merger, Fo.D.S.A. of Western Greece becomes the universal successor of the merging bodies. This means that the new structure takes over all the assets, liabilities, lawsuits and pending cases of the previous Associations. In addition, the annual contributions of the member municipalities will be determined by the new board of directors based on the amount of waste managed by each municipality.

The permanent staff of the merging bodies, as well as the staff with a private law employment relationship, will be automatically transferred to the new Body, maintaining their position and rights. The procedure also foresees the classification of the staff in new organic or personal positions that will be automatically created.
