WARTAKOTALIVE.COM, JAKARTA — The Supreme Court (MA) annulled the death sentence of Ferdy Sambo in the premeditated murder case of Brigadier J alias Brigadier Nofriansyah Yosua Hutabarat, becoming a life sentence.
In addition, the Supreme Court also cut the sentence of the convict Putri Candrawathi, wife of Ferdy Sambo, from 20 years to 10 years.
This made Brigadier J’s family very disappointed, especially his mother Rosti Simanjuntak. Because Ferdy Sambo had killed the child who was his pride and hope in a very planned and cruel way.
Responding to this, Forensic Psychologist Reza Indragiri Amriel explained that in western countries there is a distinction between life sentences with parole (life sentences with parole) and life sentences without parole (life sentences without parole).
“Let’s understand it from a risk assessment and reintegration point of view. That is, the sentencing process is carried out with the vision that someday convicts will return to society,” Reza told Wartakotalive.comTuesday (8/8/2023).
According to Reza, the task of the Directorate General of Corrections is to design programs to change the character and behavior of convicts.

“After this change occurs, it is predicted that convicts will no longer endanger society and will even be able to live productively to provide benefits to society,” he said.
From that point of view, said Reza, it can be interpreted that when the judge handed down LSwoP or life imprisonment without parole for Ferdy Sambo, the judge considered that there was no program that could reduce Ferdy Sambo’s convict’s potential danger to society.
“Assume that the rehabilitation program being implemented can change prisoners. But it is believed that these changes will not be significant enough to reduce their level of danger. Prisoners are still seen as individuals with a high risk of recidivism, even higher,” said Reza.
“So, LSwoP or life imprisonment without parole is basically as disgraceful as the death penalty. But the weight of anger and fear of victims and society, as represented by the judge’s decision, is not as high as when the death penalty was chosen as a sanction for the perpetrator,” said Reza .
The question, said Reza, is the Indonesian criminal justice system also distinguishing between life sentences with parole and life sentences without parole or LSwP and LSwoP?

“If Indonesia implements the LSwP, convicts can get a reduced sentence, and that means that in the future there is still a chance for convicts to reintegrate into society,” he said.
“My estimate is that Ferdy Sambo et al. will apply for clemency. Who knows, as the cassation judge did, the president will also change the fate of FS,” said Reza.
As is known, previously, the Supreme Court held a cassation hearing on the premeditated murder case filed by the former Head of the Propam Polri Division, Ferdy Sambo, Tuesday (8/8/2023).
