Regarding the Constitutional Court’s decision, the KPU gave this response

FAJAR.CO.ID, JAKARTA — Chairman of the Indonesian KPU Hasyim Asy’ari admitted that he would consult with the government and DPR RI regarding the decision of the Constitutional Court which granted part of the request for judicial review of the law regulating the ages of presidential and vice presidential candidates.

“The KPU must respond by sending letters to both parties,” said Hasyim at the KPU Media Center, Jakarta, Monday evening.

This is regulated in Article 75 paragraph 4 of Law Number 7 of 2017 concerning Elections which states “In the event that the KPU forms KPU Regulations relating to the implementation of the Election stages, the KPU is obliged to consult with the DPR and the government through hearings”.

“In the Election Law, in forming PKPU it is stated that you must consult with the DPR and government institutions,” he explained.

The decision of the Constitutional Court (MK) will refer to the norms conveyed in the decision. Hasyim emphasized that the KPU would convey to the government and DPR to take a position in following up on the Constitutional Court’s decision.

Previously, the Constitutional Court granted part of the request for a judicial review of Law Number 7 of 2017 concerning Elections regarding the age limit for presidential and vice-presidential candidates being changed to 40 years old or having experience as a regional head.

Case Number 90/PUU-XXI/2023 was filed by an individual Indonesian citizen (WNI) named Almas Tsaqibbirru Re A who comes from Surakarta, Central Java.

The Court concluded that the applicant’s petition was legally sound in part. Therefore, the Constitutional Court stated that Article 169 letter (q) of Law Number 7 of 2017 concerning Elections is contrary to the 1945 Constitution of the Republic of Indonesia.
