In his 2024 Daily Journal profile, Overend spoke of seeing an overall increase in trade secrets litigation, noting the rapidly evolving Artificial Intelligence sector presents “novel challenges and precedents” for such cases.

For example, a claimed secret cannot legally qualify as such if it can be readily ascertained through reverse engineering or other proper means,” said Overend. “AI’s ability to rapidly reverse engineer certain technologies could thus have a huge impact on the validity of claims.”
