AADE has been acquiring its own “electronic eye” since September, and black rents and undeclared square footage will be targeted.
In particular, a new database will be created for owners and tenants, which will be connected to the Land Registry and will have the whole picture of the real estate owned by more than 7 million taxpayers.
This is the “Property Ownership and Management Register” which will be the new tool against tax evasion.
The specific file will record the basic characteristics of the properties such as area, location, floor, electrified, incomplete, vacant, co-ownership amount as well as other information such as whether the properties are leased or granted free of charge, rent amounts and details of the tenants.
In particular, the electronic file will contain the data of the electronic portfolio created with the E9 declarations of the natural and legal persons, which will be transferred, without the intervention of the taxpayers, as well as the data on the leased properties resulting from the electronic platform of the AADE for real estate leases, as well as the E2 form of the tax returns, reports ERT.
The intersections
All of this digital data will allow for comparisons with the data of the tax returns with the aim of identifying owners who have hidden properties or have declared a smaller area in order to avoid ENFIA, income tax, presumptions, municipal fees, TAP, etc. or to avoid sanctions for arbitrary constructions. Also with the new electronic file the control mechanism will be able to directly cross reference properties declared as leased as well as the rent amounts collected and declared by landlords and tenants.
The Property Ownership and Management Register will be automatically updated every time a declaration of rental information is submitted by a property owner and will be accepted by the tenant, while it will be automatically updated every time an owner declares the termination of the lease of a property resulting in the tax administration to have a complete and accurate picture of who and how much they collect from rents.
At the same time, there will be an interconnection of the Registry with the electronic file of the income tax returns of natural and legal persons so that the incomes obtained by the owners from the exploitation of their real estate are pre-filled by the AADE in the E1 and E2 forms of their tax returns and the expenses of the of tenants for rent payments to be pre-filled in the E1 forms.
The data of this Register will be linked to the Land Registry which will enable express cross-checks to identify taxpayers who submit fictitious E9 returns to gain tax relief or pay less tax than the real value of the real estate or to collect illegal social benefits.
By extracting data from the entries in the Land Register, the auditing authorities will be able to compare them with E9 and also with E1 to check whether the taxpayers have declared the properties they own and whether their characteristics (area, type, use, location, year of issuance of the building permit, etc.) correspond to those recorded in the cadastral services.
