Rampant Online Fraud in Jakarta: Commission I DPR RI Intervenes on WhatsApp Fraud

Member of Commission I DPR RI Christina Aryani said that fraud on WhatsApp is still rampant due to unclear regulations regarding Over The Top (OTT) services. Currently the regulations governing OTT only exist in the ITE Law and PP Postelsiar. In fact, there needs to be stricter regulations regarding OTT services.

According to Christina, OTT services, such as WhatsApp, need to implement strict rules regarding Know Your Customer (KYC). Until now, the implementation of regulations regarding KYC for WhatsApp users has not been implemented. Apart from the loose regulations for the implementation of OTT services, the rise in fraud using WhatsApp is due to the lack of cooperation between OTT and telecommunications operators.

In general, the rules for OTT cooperation with telecommunications operators are contained in a derivative of the Job Creation Law. Detailing and affirming the obligation to cooperate is necessary to prevent this fraudulent crime.

Because fraud via WhatsApp is massive and detrimental to many people, especially financial service users, Christina asked the Ministry of Communication and Information (Kominfo), the National Police and the Financial Services Authority (OJK) to act immediately. Christina said that these parties need to take firm steps to prevent the increasing prevalence of fraudulent practices through WhatsApp.

“The ITE Law also explains coordination between Kominfo, OJK and Polri. With public complaints which are currently rampant, Kominfo, OJK and Polri should have been able to take firm action. The aim is to reduce losses to society,” emphasized Christina in Jakarta, Thursday. (9/11/2023).

Meanwhile, in a separate place, member of Commission 1 DPR RI Muhammad Farhan also agreed with this. The rise of fraud on WhatsApp must immediately receive special attention from the National Police and Kominfo.

Farhan said that to prevent the development of fraudulent crimes on WhatsApp, firm action needs to be taken. This member of Commission 1 also confirmed that do not use WA for authentication to avoid fraud, use SMS which is safer because according to regulations SMS is a service regulated by the Government.

In fact, Kominfo already has a standard communication platform that has been tested for security. SMS is the safest communication platform and already has a license from the Ministry of Communication and Information because conditions are very urgent, of course special attention and firm action are needed from the relevant Ministries and Institutions to be able to use a communication platform that has proven reliability and security.

To follow up and prevent the rise of fraud on OTT, Christina believes that Kominfo needs to immediately create regulations on cooperation obligations between WhtasApp and telecommunications operators. Because the rules for mandatory cooperation between WhtasApp and telecommunications operators are also mandated by the Job Creation Law.

“One of the conclusions from the hearing between Commission I DPR RI and cellular operators was to urge Kominfo to make regulations regarding the confirmation of cooperation obligations between OTT and telecommunication operators,” concluded Christina.

Highlights of OTT services being regulated were discussed at the Public Hearing Meeting (RDPU) between cellular operators and Commission I of the DPR. The meeting was chaired directly by Deputy Chairperson of Commission I DPR RI Abdul Kharis Almasyhari, attended by representatives of each director of Telkomsel, Indosat Ooredoo Hutchison, XL Axiata and Smartfren.
