“The President of the Personal Data Protection Office on Meta Platforms Ireland Limited stopped displaying fake ads on Facebook and Instagram in the Republic of Poland for three months, using real data and profile of journalist and presenter Ms . Omena Mensah” – notice to the Personal Data Protection Office. Importantly, the decision is not final and Meta can appeal to an administrative court.
The case was about the use of Omena Mensah’s image by fraudsters who published several times, among others: information about the beating or death of the woman.

“Important Decision”
We asked an expert to comment on the decision of the Personal Data Protection Office. – This is a new decision because for the first time in Poland, an entity from the big technology industry has been banned from displaying information with the image of a natural person – saying rlegal advisor Jakub Chlebowski from Peak Legal.
He says “because the exact content of the resolution is still unknown, it is not known if the resolution was implemented immediately and the ban on Meta is already in effect.
– If the decision is upheld, it may be an effective tool in the fight against online fraud, said the lawyer.

“Heads up for Meta”
– It’s also a huge headache for Meta. The decision confirms that Facebook is failing to stop illegal and harmful content (Omena Mensah’s case is just one of many). A meta that is directly at risk of liability for not complying with the prohibition must be found to prevent such “advertising” from appearing. It is also another proof that social media must take more responsibility than before for the content available through it. Not only are they information transmitters that do not affect the information displayed, but they should also be actively moderated to limit illegal user activities – the put pressure on the lawyer and remind that the decision of the President of the Personal Data Protection Office is just “the beginning of the fight”.
– For now, the decision is intended to protect their interests temporarily, because it was issued only for 3 months. This is already a big change for people who are injured by legal content on the Internet, but there is still a long way to go before the final decision of the authority, which could systematically change the situation of users , he says.
