If the driver lives in a household that pays subscription fees on a regular basis, then he shouldn’t worry. – It is worth noting that in the case of paying an RTV subscription within the household, you do not have to pay additional costs for a radio in a private caras indicated in Art. 2 clause 5 of the Act of April 21, 2005 on subscription fees – explains Witowski. The portal Bezprawnik.pl points out, however, that persons running a business for which the car is registered must pay additional fees. The obligation also applies to cars rented and leased from companies. If the contract does not transfer such a fee to the driver, these companies should pay for the subscription.
– The obligation to register and pay the subscription fee applies to enterprises, institutions and entities conducting business activity. This obligation results from the Act of April 21, 2005 on subscription fees and the Regulation of the Minister of Administration and Digitization of December 17, 2013 on the conditions and procedure for registration of radio and television receivers. The subscription fee is payable for each radio receiver (Article 2 (4) of the Act on Subscription Fees, subject to Article 2 (5) (2)). Consequently, it should be considered that the subscription fee must be paid for each company car that is used for business activities – explains Elżbieta Karasiewicz from the RTV Subscription Department, the Department of Public Media of the KRRiT Office.
We recently reported that more and more people are having problems due to non-subscription. – In the period from January 1 to March 31, 2022, 7,979 enforcement titles issued by the creditor – Poczta Polska SA were issued to tax offices, with the legal basis for the enforced obligation “OPAB – Unpaid subscription fee for using the receiver” – Wirtualnemedia.pl informed in May Ministry of Finance. This is almost three times more than the year before, because 2,714 such titles were issued then. Enforcement title is the basis for initiating enforcement proceedings. The penalty for not paying the rtv subscription is 30 times its monthly amount. A person or company caught doing it must also pay the outstanding contributions.
How much will TVP and Polskie Radio receive from the subscription and compensation?
In the budget for this year. Telewizja Polska saved PLN 2.066 billion from the RTV subscription and subscription compensation. This is more than last year, when the public broadcaster obtained PLN 1.71 billion in compensation and PLN 331.4 million from the subscription fee. Even in the years 2014-2016, before receiving the first compensation, the broadcaster had from PLN 366 to 444 million a year from the subscription itself. However, in 2010-2013 it was below PLN 300 million per year. Polish Radio will receive PLN 110.004 million (a year ago: PLN 125.91 million). Less money will also go to 17 regional stations of Polish Radio: it will be PLN 99 million to be distributed (last year – PLN 112.66 million).
In April, we informed that the Senate received a bill to eliminate the radio and television subscription. If such regulations entered into force, Poles could have as much as PLN 450 million a year left in their pockets. However, the idea criticizes, among others Ministry of Culture and National Broadcasting Council. The chairman, Witold Kołodziejski, emphasized then that the new regulations – if they were to enter – would cause an even greater destabilization of the public media financing system, radically reducing the amounts allocated to them – without introducing permanent, systemic solutions that would compensate for these financial decreases.
The Council noted that currently private subscribers account for 73% of the total. all subscription revenues, so the liquidation of this source de facto means the cancellation of the subscription altogether. What’s more: it will make it impossible to grant broadcasters compensation for lost subscription revenues in the future. Another negative effect of introducing the new solution would be depriving Poczta Polska of income from subscription fees.
