Quebec collective action against Apple can go forward | Business | The sun

The Superior Court of Quebec welcomed the process started last December on behalf of two applicants and which evokes, among other things, the notion of planned obsolescence of the batteries of devices sold by the American giant.

A first group will represent “all consumers who have purchased since December 29, 2014” an iPhone, an Apple Watch, an iPod “and / or” a MacBook computer “equipped with a rechargeable battery”.

The other group concerns those who have purchased, since December 20, 2015, an extended warranty and “who were not informed of their legal warranty”, at the time of purchase, from the Consumer Protection Act.

According to the claim, “AppleCare” is no more advantageous than the legal warranty under the law and its price is disproportionate to the point of causing objective injury to all buyers of AppleCare.

The petition was filed in court after Apple admitted it had slowed the performance of some iPhone phones. The company has also admitted battery life limits for devices – iPhone 6s and 7s.

Last March, the Superior Court allowed an application for authorization to go ahead. The plaintiff alleged a slowdown in his smartphone, an iPhone 5, following an update.

This device was not, however, cited by Apple when the Californian giant admitted its wrongs in 2017 about other smartphones.
