During the hearing, several versions are opposed. That of the victim and those of the three defendants. On the bench of civil parties, the Montluçonnais, who would have been the target of a settling of scores, confirms what he has already said several times during the investigation.
On February 22, 2019, while he was installed in the bar Le Manhattan, avenue du Président-Auriol, in Montluçon, a dozen people allegedly attacked him. At their head, the Onal brothers accompanied by young people from the neighborhood. He explains the reason for this attack by a drug debt of 1,000 euros that he would not have repaid.

Different versions
He describes a punitive expedition with punches, throwing stools and billiard balls and especially stab wounds carried in particular to the head and neck (earning him ten days of ITT). A version confirmed by several witnesses.
The two brothers deny it outright. The oldest, Ilhan Onal, 46, claims not to have been to the bar and claims to have stayed with his sister all afternoon. His youngest, Hulise Onal, 43, claims to have gone there but was himself the target of beatings from the accuser and his friends.
The third defendant, a 21-year-old Montluçonnais, who would be one of the young people from the neighborhood who came to help the two brothers, indicates that he just stopped in the bar, after the fact, out of curiosity when he saw a crowd.

Hulise Onal however assures to have seen a dozen people enter (the same as those described by all the witnesses) but puts forward the hypothesis of the “Albanian milieu”, who came, the same day, to attack the victim.

“Targeted aggression”
But for the public prosecutor, this thesis does not hold. Referring to a “targeted assault”, it requires four years of imprisonment against the Onal brothers, with a ban on stay in Allier for four years. For the 21-year-old Montluçonnais, he is asking for two years of suspended imprisonment. For the three defendants, he finally calls for a ban on holding a weapon.
Me Douet and Me Canis, lawyers for the two brothers, returned to the investigation, pleading the release in view of a “lack of checks” and “deficiencies” in the file.
The court finally sentenced the Onal brothers to two years’ imprisonment (Hulise is being kept in detention) with a ban on holding or carrying a weapon, as well as a ban on residence in the Allier for two years. The third was sentenced to a one-year suspended sentence with a ban on holding a weapon.
They must also pay the civil party jointly and severally 2.810 euros for their damage as well as 700 euros for legal costs.
