The Public Prosecution Service had demanded eight years in prison and a TBS with compulsory treatment.
Psychosis
On July 17, 2022, 23-year-old S., ICT specialist at the Ministry of Defence, cut the girl’s throat with a large knife in a bedroom. His girlfriend, her brother and her mother were elsewhere in the house. The women then fled into the street with Emily to ask for help.
According to his psychiatrist and psychologist, S. was in a psychosis as a result of schizophrenia during his act. Due to the paranoid delusions, the murder can be attributed to him to a greatly reduced extent, according to the behavioral experts. They advised the court to impose a TBS with compulsory treatment.
High chance of recurrence
The military chamber, which handles the case because S. was employed by the Ministry of Defence, does not assume murder, but manslaughter, as the Public Prosecution Service does. The judge takes the man’s disorders into account, which is why the prison sentence imposed is different from the eight-year prison sentence demanded by the public prosecutor.
The military chamber also ruled that TBS with compulsory treatment is necessary because the risk of recurrence is high and to guarantee the safety of others.
