Proposed Revision of Village Law Includes Deliberation for Consensus in Selecting Village Head

Legislative Body (Baleg) DPR is currently preparing a draft revision of Law Number 6 of 2014 concerning Villages. One of the things that was agreed to be included in the revised draft was that the village head would be determined through deliberation for consensus if there was only a single candidate.

The approval was taken at a working committee (panja) meeting on the revision of the Village Law in the DPR Baleg meeting room, Parliament Complex, Senayan, Jakarta, Tuesday (27/6/2023). The meeting was chaired by Supratman Andi Agtas who is also the Head of the DPR Baleg.

It is proposed that the village head will be determined through deliberation for consensus if there is only one candidate alias single candidate. All factions in the DPR agreed to the proposal.

Firman Soebagyo, Baleg member of the Golkar Party faction, explained his reasons for agreeing to the proposal. Firman considered that the rule that one candidate for village head must fight an empty box was inefficient both in terms of time and budget.

“Because compared to the Pilkades fighting an empty box and then the empty box wins, that will happen, I’m sorry, this is a serious problem. There could be conflicts, inefficiencies and so on,” said Firman in a DPR Baleg committee meeting.

Apart from being inefficient, Firman said that the arrangement for selecting a single village head candidate against an empty box is also not regulated in the Village Law and Law Number 10 of 2016 concerning regional elections. For this reason, Firman assessed that the Village Law needs to provide confirmation regarding this matter.

“That means it’s a gray area, why aren’t we now more repressive in making laws, regulating everything that has happened and then it happened and there are no rules yet,” said Firman.

“Therefore, it is important that the presence of the Village Law provides an affirmation and this does not benefit anyone,” he continued.

Member of the Legislative Council of the Democratic Party Hinca Panjaitan also agreed to the proposal. He recounted the inefficiency in terms of security if the village head election was against empty boxes and repeated.

“Once I asked about securing the Pilkades, which is more difficult for the police, securing the presidential election or securing the village election. It turned out that it was more difficult to secure the village election because the marking zone was small so the BKO was from the side into the village and so on,” Hinca said.

“Now what is the urgency against empty boxes taking advantage of the great facilities and security earlier, and if you win in an empty box it will be repeated again. So I want to see our common sense in this system, the village head election is different from the regional head election,” he continued.

Meeting leader Supratman Andi Agtas also accommodated the aspirations of the nine factions present. The nine factions of the DPR agreed to abolish the rule for single candidate for village head against empty squares.

“So all the articles related to the election of the village head where the squares are empty, all of them are deleted, perfected, replaced that the single candidate is directly determined by the village election committee,” added Supratman and agreed by all members.
