Proposed Changes to Health Law Place New Obligations on Patients

PP-DB submitted a bill for changes that introduce new obligations for the patient. The changes are in the health law and add the current modest four points to the responsibilities of people who need medical help. Currently, the patient is required by law to take care of his own health; not to harm the health of others; to assist medical care providers in activities related to improving and restoring his health; to observe the established order in medical facilities. The texts seem purely theoretical – it has not been heard of anyone being sanctioned for not taking care of their health or for damaging the health of others.

With the new texts, the deputies introduce new requirements. One obligates the patient, when he seeks medical help, to provide doctors with access to all health information regarding his health condition – accurate and comprehensive data when taking an anamnesis; diagnostic and treatment activities carried out to date; declarations of will made regarding medical care. Much of this information should now be available to physicians through the patient’s health record.

In addition, it is expressly recorded that the patient is obliged to comply with the doctors’ prescriptions. Such a text is currently in the law on health insurance, but it only applies to insured persons, the petitioners comment.

With another text, the patient undertakes not to carry out actions that would damage the honor or dignity of medical specialists and not to spread false information about them or about the diagnostic and treatment procedures carried out.

The patient will also be obliged not to use threats or violence towards the medical professionals, and also to comply with their prescriptions. He has no right to enter a hospital with a weapon unless he carries it for work.

The deplorable level of prevention in our country is answered by the obligation for the patient to participate in the activities of prevention, prevention, non-spreading of infectious diseases and health promotion provided for by law. The patient can even now be fined if he misses the mandatory annual preventive examination with his personal doctor, but these fines have been in the law for years and no one dares to apply them.

In the presence of an infectious disease, the patient must comply with mandatory isolation measures and provide accurate information about contact persons.

The petitioners – Alexander Simidchiev, Vasil Pandov, etc., claim that now the care for health and quality of life was perceived mainly as an obligation of the state, and not as an obligation and responsibility of every citizen for his health. They expect the changes to create “a new type of health culture in our country, with the strengthening of personal responsibility and the development of personal skills, knowledge and opportunities to strengthen individual and public health”. It is not clear on the basis of which obligations a person is expected to develop “personal skills and knowledge” to strengthen personal health, since the attitude towards the patient and his relatives in our country often does not imply that they receive all the information about their condition.

CONTEXT

The DB project is not new – it was introduced exactly a year ago in the previous parliament, but was not brought to the final stage. Now, however, the texts come in the light of the most recent scandal in healthcare in our country – with the advisor to the Minister of Defense and his experiences in “Pirogov”. Mustafa Emin resigned from his post in the Ministry of Health after the entire medical team from his case confirmed that he threatened the Minister of Health in order to get help (there are no recordings of his words, the cameras in “Pirogov” turned out to be silent). An internal review at the hospital confirmed that Emin waited over three hours for his child’s wound to be treated, which took 11 minutes.

Emin’s case became political, thanks to the active intervention of GERB and Delyan Peevski (Emin is considered the main enemy of DPS in Ribnovo). All politicians denounced aggression, threats and abuse of office. Unfortunately, none of them felt it necessary to comment on how it was possible to wait three hours for medical help and only one team to receive children in an anti-shock room. Not a single politician has commented on why in all of Sofia emergency cases of children are accepted only in “Pirogov”, and all other hospitals send them away. However, many parents shared similar stories of being turned down by other hospitals and waiting 3-4 hours in the corridors of the emergency institute.

After a TV appearance by the director of “Pirogov”, the mother of 15-year-old Danaya – Ani Stoyanova, wrote an emotional post in which she said that when her daughter was fighting for her life, it was a call from the Minister of Health that made the doctors come to help . Annie also tells shocking details of those difficult hours about the attitude of the medics. “Without ‘I have a person’ it’s hard to survive!” she wrote.
