Proposed Amendments: Increased Sanctions and Strengthened Liability for Illegal Movement across State Borders

It is planned that both the minimum and maximum sanction applicable to such a criminal offense will be increased, that is, imprisonment for a period of up to three years, probation supervision or a fine can be applied for it.

With the amendments to the law, it is planned to exclude the alternative punishment to deprivation of liberty – community service – because, as noted in the annotation of the draft law, this type of punishment is insufficient to deter persons from committing such a criminal offense.

Also, the draft law envisages strengthening the criminal liability for the illegal movement of a person across the state border, if it is done during the regime of increased border protection.

As noted in the annotation of the draft law, the hybrid attack organized by Belarus floods its neighboring countries of the European Union with streams of migrants and artificially creates a migration crisis on international borders.

The large number of people who want to cross national borders also creates tempting conditions for those who want to organize or implement the preaching of illegal immigrants inside the European Union. This poses a significant threat to public and national security, so these violations must be dealt with with the maximum severity of the law, and the criminal penalties must be such as to deter other persons from engaging in such criminal activities, the annotation states.

The Legal Commission will ask the Saeima to determine the urgency of the draft law, as well as to include it in the agenda of the September 29 session, informed the Chairman of the Legal Commission Andrejs Yudins, emphasizing that the commission could advance the draft law in the Saeima on October 5.
