Increase the number of people participating in unemployment insurance
Presenting the report, Minister Dao Ngoc Dung said: Government Propose to add 2 subjects to participate in unemployment insurance compared to the current law.
More precisely, employees who have entered into a fixed-term employment contract of 1 month or more (currently 3 months or more); People who work part-time and whose monthly salary is equal to or higher than the salary that serves as the basis for the lowest payment of compulsory social insurance.

Between 2015 and 2023, the number of people contributing to unemployment insurance increases over the years (an average increase of around 6%/year). By 2023, the number of people benefiting from unemployment insurance will represent 31.5% of the working population.
Strive to achieve the goal that by 2030, about 45% of the working-age population will participate in unemployment insurance, as required by Resolution 28 of the Central Committee on Policy Reform social insurance, constitutes a major challenge.
Furthermore, the current labor law stipulates that subjects participating in unemployment insurance do not cover all subjects related to labor relations, including the two subjects proposed above by the government.
Alongside the increase in the number of people contributing to unemployment insurance, the government is proposing to relax unemployment insurance payment levels.
Thus, employees pay a maximum of 1% of their monthly salary; Employers contribute a maximum of 1% of the monthly salary fund of employees participating in unemployment insurance.
The State finances a maximum of 1% of the monthly wage fund for unemployment insurance for workers affiliated to unemployment insurance and is guaranteed by the central budget.
Minister Dao Ngoc Dung further informed that the current law stipulates that the unemployment insurance compensation rate for employees and employers is set at 1% of the monthly salary. Thus, flexibility in adjusting unemployment insurance contributions is not guaranteed, particularly in the event of natural disasters, epidemics, economic crises, recessions or when the fund has a significant surplus.
Concerning the conditions for obtaining unemployment benefits, the government also proposes to add an ineligible case: employees are dismissed in accordance with labor law or are subject to disciplinary measures and forced to leave their job in accordance with employee law.
Receive unemployment benefits according to the “pay – benefit” principle
Checking the above content, Chairman of the Social Committee Nguyen Thuy Anh said that the Social Committee requested the drafting agency to continue to supplement and evaluate the impact of the new regulations and find solutions to guarantee their effectiveness, overcoming the current limitations of their implementation.
According to Ms. Nguyen Thuy Anh, expanding the target audience as in the bill is not the only solution to achieve the goal of having around 2030% of the working population participating in unemployment insurance by 45; It is necessary to implement many synchronous solutions such as communication, inspection, testing solutions…

According to the inspection agency, a number of regulations related to unemployment insurance need to be examined, calculated and further clarified, such as the regulation on the maximum unemployment insurance compensation rate of 1% of salary monthly.
In addition, the Social Committee also took note and examined the regulation according to which employees dismissed or forced to resign as a result of disciplinary measures are not entitled to unemployment benefits.
Because according to the provisions of labor law, employees who are dismissed in accordance with labor law or who are sanctioned and forced to resign in accordance with the Public Employees Act are not entitled to severance pay.
Therefore, in order to ensure the rights of workers, the drafting agency is requested to study and consider removing this regulation in order to create conditions for the above-mentioned workers to receive unemployment benefits on the basis of the basic principle “close – enjoy”.
