Promiwirt killed: widow protests innocence

It’s a completely new trial, new judges, new jury – only the murder charge remains the same. The public prosecutor’s office accuses the Romanian-born woman of stabbing her husband in a dispute with a kitchen knife in March 2019. The jury unanimously denied this in the first trial in December 2019. The act was deliberate bodily harm resulting in death.

According to the Supreme Court, such a judgment was not admissible – only a guilty verdict for murder or an acquittal was possible. That is why the process is being rolled out again.

Defense attorney: “It wasn’t a murder”

The 32-year-old’s defender, Kurt Jelinek, is hoping for his client to be acquitted. “I hope that the jury in this trial, like the jury in the first trial, will conclude that it is not murder. And I really believe that it’s not murder, ”said Jelinek.

Stefan Rieder from the White Ring, who participates in the process for the private parties, sees it differently. “In the case of murder, the conditional intention to commit murder is sufficient: that is, if I consider it seriously possible and come to terms with it, then I am in the realm of murder. In this respect, it is easier to justify the murder than to deliberate in the case of bodily harm. For me it was murder, ”argues Rieder.

As in the first trial, the 32-year-old defendant spoke of an accident on Tuesday. Exhaustion and jealousy led to the argument that night, which ended with a fatal knife stab. A judgment is to be issued on Thursday.
