The young man was arrested last November 12 near a high school in Lunéville (Meurthe-et-Moselle).
Arrived at the scene, the police discovered an individual on the sidewalk, with behind him a bag sufficiently open to reveal the barrel of a weapon. They had been called a little earlier by this 18-year-old who had claimed to be the victim of an assault.
It is not, it intended to kill police officers or even passers-by, had revealed the public prosecutor of Nancy. The police investigation showed that he had exchanged messages with a 16-year-old teenager where he explained that he wanted to take action against the police.
Several counts of indictment except for “attempted murder”
The public prosecutor of Nancy François Pérain had requested his placement in provisional detention and his indictment for “attempted murder on a person holding public authority”. But the examining magistrate had decided his indictment in particular for “infringements of the legislation on the weapons” and his placement under the status of assisted witness for the attempted assassination.
A decision that did not satisfy the prosecution. He appealed against the decision of the investigating judge. According to The Parisian, the investigative chamber of the Nancy Court of Appeal decided on Thursday November 26, 2020 to reject the appeal of the prosecution who demanded the placement in pre-trial detention of the young adult and his indictment for the proposed attack against the police.
Satisfaction of the suspect’s lawyer
The lawyer for the young man, out of school and addicted to the GTA video game, said he was satisfied with this court decision.
“He does not weigh any charges on my client justifying an indictment for attempted murder. This would suppose a commencement of execution which would have failed in its effect only because of circumstances beyond the control of its author. However, my client has deliberately given up on his attack plan even before having started it, ”the lawyer for the young man, Me Kévin Duprat, was satisfied.
Anger of the police unions and Jean Rottner
The young man’s release had provoked the anger of two police unions, Unit-SGP Police FO and Alliance, who considered that “leaving this individual free is dangerous”.
The President (LR) of the Grand Est region Jean Rottner had also denounced this decision of the examining magistrate qualifying it as “above ground”.
