The commissioners applied two fines, one of 5,000 lei and the other of 7,000 lei. The discount campaign, called “Find Mr. Cuponescu’s money”, is carried out through 10 coupons that are included in the magazine, which is offered to each customer who buys products worth at least 35 lei.

Findings of CJPC Alba

In the first case, it was found that “the practice of offering products at an exclusive price per coupon, which you benefit only through the magazine related to the bidding period, a magazine that is received at the cash register for purchases of at least 35 lei, is a commercial practice. considered aggressive, commercial practice considered incorrect in any situation, as it is presented and regulated in Annex no. 1 aggressive commercial practices from Law 363/2007 point 8 letter b).

In the second case, it was stated that products with a discount on coupons were, in the magazine, promoted at other higher prices. “Therefore, it is beyond any doubt that, in the discount applied to coupons, another price is indicated at the old price, higher than the price indicated on the products mentioned above and which are found in the magazine outside the coupons,” they said. ascertained by the Commissioners for Consumer Protection.

They also claimed that any trader who announces a price reduction should relate it to the reference price charged in the same sales area for identical products. The reference price is the lowest price charged in the same sales area during the last 30 days before the application of the reduced price.

Profi’s reaction

Profi Rom Food owns a number of 1,486 stores in Romania. The fined company specified that through the campaign it did not violate the provisions of Law no. 363/2007 regarding the aggressive commercial practice considering the fact that the constitutive elements of the contravention retained in relation to the consumers are not met and they were informed about the way in which the campaign will be carried out.
