Interview of Valeria Veleva with former constitutional judge Prof. Plamen Kirov.
– Prof. Kirov, the Ministry of Finance has created a bill for which Epicenter. bg first wrote, with which the authorities, under the guise of the idea of ”protection of national security from risks to the economic and financial system of the state”, will make criminal lists without trial and sentence, will freeze money and assets for denunciation. How does this fit with our constitutional rights?
– I think this is a joke! But, if it is not a joke, it betrays the downright fascist leanings of those who wrote this bill. His philosophy is perverse. It does not fit into the norms of the European Convention on Human Rights and Fundamental Freedoms, nor into the European treaties to which Bulgaria is a party, let alone into the constitutional framework of our Basic Law. These people do not realize that they will not live forever, and as soon as they have the imprudence to adopt a law with such content, they will be the first addressees of its application.
– Why?
– Because this law can be used by anyone who wants to deal with their economic and political opponents.
– Is this emergency legislation?
– This is extraordinary legislation. If this bill is passed, it will mean that the Council of Ministers is acting under delegated legislation, which our Constitution does not allow. If the parliament adopts such a law, it will practically delegate to the Council of Ministers to limit the rights of citizens, which the Bulgarian Constitution does not grant to the executive power.
– Doesn’t this remind you of the time of the Cheka? Reading the texts of the bill, I thought of this time that we know from the constructions?
– Oh no, the Chekists are innocent babies compared to those people who wrote this bill and the norms they want to implement.
– What is the worst thing about this bill?
– The most frightening thing is that it is aimed not only at the owners, but also at the holders of property or assets. Without proving whose property or asset it is, it is enough that it is in me, and suspicions can arise that it is directed against state interests. This is a perversion! This is violence against the law! Should I ask them how this fits into their high claims for Bulgaria as a democratic, free and legal state? Where did they learn these standards, where did they read them, and where are they applied? Maybe at Harvard? Is that where they learned about the rule of law, about applying the Constitution.
– In the draft law, the phrase “National criminal list” of persons who fall under the law and which will be drawn up by the Minister of Finance, is written with a capital letter N. This means some institutionality of this black list.
– Of course! This blacklist will continue – there will be national penal colonies, concentration camps. Naturally, one will follow the other!
– So anyone can enter this list by denunciation!
– This is how the National Socialist Party operated through the Gestapo during the “most democratic regime” in Germany from the late 1930s and 1940s.
– How can today’s young rulers give birth to such a thing?
– When in Germany they adopted the ideas of fascism, it was explainable as thought and action. Then, too, young people embraced these ideas.
– The law will be implemented by an Interdepartmental Council and the idea is for it to be an advisory body to the Council of Ministers and to be appointed by it.
– So then the Council of Ministers will really act just like the Cheka.
– There is one more thing, in the bill it is written that “for the cases within the scope of this law, the administrative law rule that the appeal stops the execution will not apply”.
– Of course! It doesn’t surprise me that they offer it. Because there is no judge who would allow such an action. Any magistrate would stop such executive action. That is why the authors of the law insured themselves. They say, whether you will complain in court, it does not matter, we act as we have decided. Let the court rule as it wants and when it wants. What the magistrates will say is irrelevant to us.
– How, 30 years after the transition that opened the way for democracy in our country, did we get to the point of talking about fascism in Bulgaria?
– We turned a circle of 360 degrees. And we returned dark from where we started. Even worse, because then there was only one Chapter Three of the Law on Citizens’ Property – confiscation of non-labor income.
