The dismissed head of the Alexandrovska Hospital, Prof. Boris Bogov, remains in office. The reason – the new management of the medical institution, appointed a few days ago by the caretaker Minister of Health Dr. Stoycho Katsarov, cannot be entered due to a clear contradiction in the registration documents.
On the one hand, they stated that hospital managers were appointed following a competition. On the other hand, the order itself stated that they would hold the posts until a competition was held.
On Wednesday, the Registry Agency explained the refusal. Their arguments become clear from a decision, a copy of which “24 hours” has.

The agency’s refusal to do so goes beyond its legal powers. What are they actually trying to tell us with this action – we are untouchable, we can do everything with impunity, you can’t even change us. We can.
I call on the Minister of Justice to verify the legality of the actions of the Director of the Registry Agency and, if he finds that she has exceeded her powers and violated the law, to dismiss her from her post.

On June 5, Dr. Stoycho Katsarov appointed Dr. Atanas Atanasov as interim director of the hospital in place of the dismissed Prof. Boris Bogov.
Until then, Dr. Atanasov was a procurator at the severely ill hospital in Lovech. The composition of the Board of Directors was also changed. The new one was headed by Prof. Rumen Stoilov.
However, on June 8, the Registry Agency refused to register the hospital’s new management because the documents were not submitted in accordance with the law.
It is clear from the Minister’s order that the appointment of Prof. Bogov was under the Public Enterprises Act, which

Exceptions for the appointment of management bodies without holding a competition are allowed only for a municipal public enterprise for a period not exceeding 6 months. However, Alexandrovska Hospital is a state public enterprise.
However, no competition was held. The same order stated that Dr. Atanasov and the board of directors would remain until the competition.

“The conditions and procedure for conducting it shall be regulated in the regulations for application of the law,” the decision reads.
It says more,
that the said contradiction constitutes an obstacle to the unequivocal conclusion that the election of the new members of the management body is the result of a duly conducted competition procedure in accordance with the law.
In view of the above and not establishing the existence of the circumstance requested for registration and its compliance with the law, the registration of new members of the board of directors of the company should be refused on the basis of the submitted application.
Thus, Prof. Bogov remained at the head of “Alexandrovska”. Prof. Dimitar Bulanov and Assoc. Prof. Alexander Oscar retain their positions on the Board of Directors.
They were replaced by Dr. Katsarov without a report from the inspections at the hospital. And the former Minister of Health Prof. Kostadin Angelov described the removal of the leadership as a “punitive action”.
For comparison, the agency gives an example with another state company, which is identical as a legal hypothesis – “North Central State Enterprise”. It was also a public enterprise within the meaning of the law. An application of the Minister of Agriculture, Food and Forestry dated 1 June was attached to the application for changes in the management, in which no such contradiction was found. At the moment, the application has been considered and the change has been registered, the agency said.
