Proceedings have been instituted for the case of the meeting between Tsatsarov and Sasho Donchev – 2024-08-25 02:42:52

/ world today news/ In view of the increased public interest in the publicly known meeting of the chief prosecutor Sotir Tsatsarov with the businessman Sasho Donchev in the office of the businessman Georgi Gergov, the Inspectorate at the Supreme Court announces that proceedings have been initiated in the case, the Supreme Court announced.

The administrative proceedings are in accordance with chapter nine, section I “b” of the Law on the Judiciary (JSW) – Inspections for integrity and conflict of interest and for establishing actions that damage the prestige of the judiciary and inspections related to violation of independence of judges, prosecutors and investigators. It was formed on the basis of a signal received by the Inspectorate at the SJC and the proceedings are at the stage of removing irregularities in the signal.

The Judiciary Act does not allow the disclosure of further details beyond the existence of an established proceeding. Art. 175p, para. 2 of the Criminal Code obligates the persons entrusted with the examination of the report not to reveal the identity of the person who submitted the report and not to disclose the facts and data that have become known to them in connection with its examination. This information is an official secret (Art. 175r, Para. 3 ZSV).

The procedure for checking a signal under Art. 175l, para. 5 of the Civil Code, is regulated in Chapter Nine, Section I “b” of the Civil Code and in the Internal Rules for carrying out inspections under Chapter Nine, Section I “b” of the Civil Code by teams of the Inspectorate at the SCC, adopted by decision of January 6, 2017 . and published on the institution’s website.

The Law on the Judiciary (Art. 175l, para. 2) and the cited Internal Rules provide for the possibility, in addition to a report, for the Inspectorate to refer itself to the SJC, including by publication in the mass media, if it meets the conditions listed in Art. 175l, para . 5, items 2-4 conditions – contains the names of the person against whom the report is filed, the position held by him, specific data about the alleged violation, including the place and period of the violation, a description of the act and other circumstances, in which has been carried out, reference to documents or other sources that contain information supporting the stated, including the indication of data of persons who could confirm the reported data or provide additional information.

The existence of initiated proceedings based on a report does not require the initiation of a self-referral investigation.
