Problems with credit or canceled overdraft of a non-existent GbR
Hello everyone,
I am in a very desperate situation and hope to find advice and support here. Some time ago I founded a GbR with my father, but the partnership agreement was based on false information. It was never my intention to harm anyone and I have always paid all my loan installments on time. There have also never been any problems with the law or other difficulties.
Now the GbR account has been closed by the bank and my father’s account has been seized, even though he had no power of attorney for the account and I handled everything myself. The bank is very strict and has so far refused to negotiate any repayment of installments. I am now faced with the question of whether I should report myself for the fake GbR contract. I am very afraid of being reported or of other legal consequences.
My company is actually doing well and sales are good. Nevertheless, the bank is putting me under enormous pressure and on top of that they charged 19% interest on the overdraft, which I consider to be usury.
I don’t know what to do anymore and am urgently looking for advice on how best to proceed in this situation. Has anyone had similar experiences or can tell me what I should do now? I really want to prevent the situation from escalating further and am looking for a solution to deal with this crisis.
