The action group Ministry of Privacy is challenging the extension of the Covid Safe Ticket (CST) to include the catering industry with the Constitutional Court. According to the organization, the measure is disproportionate.

The corona certificate – which shows that you are either fully vaccinated or have recovered from the corona virus or have tested negative – was initially introduced to make travel within Europe possible again. After that, Belgium introduced the CST for events, and recently also for catering establishments and sports clubs.
“However, the recent expansion of the CST exceeds any possible trade-off of proportionality. Medical data is extremely sensitive and protected under the GDPR (European privacy rules, ed.)‘, says lawyer Matthias Dobbelaere-Welvaert, the founder of Ministry of Privacy. ‘From a privacy perspective, both the application and the broader ethical aspect are particularly problematic. As a privacy watchdog, we can therefore do little but take action against this.’
Dobbelaere-Welvaert refers to an earlier advice from the Data Protection Authority – the former Privacy Commission – about the CST. She spoke of a disproportionate measure, since there are sufficient other measures available, such as better ventilation (which is often still missing), keeping distance, mouth masks and others, each of which better protect the privacy of the citizen. the. ‘The government hardly took this advice into account, if at all.’
‘Leaving this pass without any form of protest is opening the door wide to unintentional and future abuse of such health cards’, emphasizes Dobbelaere-Welvaert. “The government is currently considering allowing employers to scan the CST. This is a perilous exercise for our future, and it seems that the government is not sufficiently aware of the long-term consequences. Nobody cares whether you inject or not. And it’s better to stay that way.’
