Privacy expert Magali Feys is not very surprised at the data leak. “Unfortunately, we see it more often in our practice. Data leaks do happen. That is a pity. It is of course even more unfortunate that it happens to the government, because that can have a greater impact.”
“We see that privacy legislation is often not sufficiently taken into account in advance,” Feys continues. “Not so much from a legal point of view, but also from a technical point of view. It is very important that you also do a technical analysis of information security.”
“That is not yet sufficiently ingrained today, neither in governments nor in companies. That really has to change. And of course the government must set an example in this,” says lawyer Feys, whose office also assists government services with regard to privacy. “I do see a change, but it can certainly be more on the agenda.”
Regarding possible government liability in this case, Magali Feys notes that there are two aspects. “How could the data leak have occurred, were the correct checks not done in advance? But equally important: how was the response to the leak? And immediate action was taken here.”
