A restaurateur of the historic center of Rome, in financial difficulty for the crisis from coronavirus, showy to reject a discount on the rent from the owner of the premises, addressed to the court, which with a sentence of the VI civil section accepted the request, establishing a temporary decrease of the fee. The story told on the website of Red shrimp, according to which the retroactive decision will result in a reduction of the 40% on the rent due for the months of April and May 2020, and 20% for the period between last June and March 2021.
Clemente Quaglia, creator of the restaurant Clotilde in the Campo Marzio district and already a veteran of Roman catering, he pays the property 96 thousand euros a year (8 thousand per month) from the year of opening, 2017. The judge’s decision was guided by presumption that in the absence of one reduction of the expenses the business would have seriously risked to close (the provision also established the suspension of the surety guarantee, up to a debt of 30 thousand euros).
The ruling could do law, but after the lockdown that paralyzed Italian restaurants for over two months, the return to normal, in a historic center usually crowded with tourists arriving from all over the world, slow and uncertain. For this the Italian Federation of Public Exercises (FIPE) has repeatedly done appeal to the legislator to invite him to regulate the difficult dialogue between restaurateurs and owners of the walls of the premises, who too often appear deaf to the request to reach an agreement for the reduction of the rent. Taking into account an average decline of 40% in turnover, explains Fipe, necessary redefine chords on rents for it to be more sustainable, so as to avoid the bankruptcy of the activities (to the advantage, however, of the owners themselves, who would avoid finding themselves with a vacant property on the market, with little possibility of replacement in a short time). Since spontaneous compromise is unlikely – continues the Federation – the Government should intervene more decisively.
