The president of the Republic, Daniel Noboahas called for a referendum through Executive Decrees 162 and 163, issued the night of this Friday, February 9, 2024. The vote could take place in April.
Ecuadorians must answer ten questions: six of popular consultation and four of referendumthat is, in which amendments to the Constitution are proposed.
The constitutional amendment is a change to the text of the Fundamental Charter in which the structure of the State is not altered., and can be carried out through popular consultation. The constitutional reforms, no, and they must follow a process of two votes in the National Assembly and subsequently be submitted to another referendum.
These are the popular consultation ones:
Do you agree with that the Armed Forces carry out control of weapons, ammunition, explosives and accessories, permanentlyon the routes, paths, roads and corridors authorized for entry to social rehabilitation centers?
Do you agree that increase the penalties of the crimes of: (i) terrorism and its financing, (ii) production and illicit trafficking of substances cataloged subject to inspection, (iii) organized crime(iv) murder(v) hitman(vi) human trafficking(vii) extortive kidnapping(viii) arms trafficking(ix) money laundering y (x) illicit activity of mining resourcesreforming the Comprehensive Organic Penal Code in accordance with the Annex to the question?
Do you agree with that people deprived of liberty serve the entirety of their sentence within the social rehabilitation center in the crimes detailed in the Annex to the question, reforming the Comprehensive Organic Penal Code as stated in the aforementioned Annex?
Do you agree with that the crime of possession or carrying of weapons, ammunition or components that are for the exclusive use of the Armed Forces or the National Police be classifiedwithout affecting firearms permitted for civilian use, reforming the Comprehensive Organic Penal Code in accordance with the Annex to the question?
Do you agree with that weapons, their parts or pieces, explosives, ammunition or accessories that were instruments or material object of a crime, may be destined for the immediate use of the National Police or the Armed Forcesreforming the Comprehensive Organic Penal Code in accordance with the Annex to the question?
Do you agree with that the State proceeds to be the holder (owner) of assets of illicit or unjustified originsimplifying the procedure of the Organic Law of Domain Forfeiture, according to the Annex to the question?
These are the questions for the referendum:
Do you agree with allow the extradition of Ecuadorianswith the conditions, requirements, restrictions and impediments established in the Constitution, international instruments and in the Law, amending the Constitution and reforming the laws, in accordance with Annex 1?
Do you agree with the establishment of judiciaries specialized in constitutional mattersboth in the first and second instance, for the knowledge of the jurisdictional guarantees that correspond to them, amending the Constitution and reforming the Organic Law of Jurisdictional Guarantees and Constitutional Control, in accordance with Annex 2?
Do you agree that the Ecuadorian State recognizes international arbitration as a method to resolve investment, contractual or commercial disputes?
Do you agree with amend the Constitution of the Republic and reform the Labor Code for fixed-term and hourly employment contractswhen it is concluded for the first time between the same employer and worker, without affecting the acquired rights of the workers, in accordance with Annex 4?
