The investigation will not go further. Four months after the start of the case, the public prosecutor’s office Nanterre (Hauts-de-Seine) has decided to dismiss the eight complaints filed against Patrick Poivre-d’Arvor, as he announced on Friday, June 25, 2021. The former presenter of the TF1 JT was accused of rape, sexual assault and sexual harassment by eight women.
Prescription
In a press release, the Nanterre prosecutor’s office indicates that the acts of rape denounced by six women are prescribed, because they are more than ten years old, just like the facts of sexual assault and attempted sexual assault, being older than six years.
Moreover, the prosecution considers that the acts of sexual harassment described by four women committed before 2012 are not sufficiently characterized “in the absence of constituent elements required by the criminalization texts (absence of repetition, pressure, sexualized comments made, or even traces of phone calls) ”.
Lack of evidence
February 15, 2021, Florence Porcel, writer of 37 years, had lodged a complaint against the former flagship presenter of the JT for rapes she allegedly suffered: an unwanted sexual intercourse in 2004 and an imposed fellatio 2009, “Period during which agreed reports would also have taken place” specifies the prosecution.
Florence Porcel had notably mentioned an aggravating circumstance of abuse of power, and depicts a relationship of influence on the part of the journalist now 73 years old.
The facts of 2004 would have taken place in the office of PPDA at TF1, in Boulogne-Billancourt, at the end of a television newscast and those of 2009 at the headquarters of the production company A Prime Group, still in Boulogne-Billancourt.
However, the prosecution explains: “it results from the investigations that these facts cannot characterize the crime of rape insofar as there is no evidence to confirm the comments of one or the other concerning the existence of this scene. The checks carried out on the configuration of the premises in which it would have taken place did not confirm that it could have taken place out of sight. The other elements of the procedure also do not make it possible to establish, supposing that the contested sexual intercourse took place, the intentional element characterized by the absence of the victim’s consent and its perception by the respondent. “
PPDA’s complaint dismissed
In addition, PPDA had filed a complaint for slanderous denunciation against Florence Porcel. It was also closed, “in the absence of demonstration of an intention to harm” adds the prosecution. For his part, the former presenter had always denied the accusations.
During their investigations, the investigators of the Brigade
Repression of Crime Against the Person (BRDP) of the Prefecture of Police of Paris interviewed 22 women. In addition to Florence Porcel, seven women subsequently filed a complaint.
