Poste Italiane, class action for interest-bearing bonds: which series is it about

FederConsumatori has launched an initiative that affects some owners of postal savings bonds issued after 1 July 1986. The association has decided to take a class action against Poste Italiane to facilitate all consumers who would have collected less than initially expected and corresponding to the rate of the voucher.

Many customers have lost the lawsuit against the company, as FederConsumatori itself explains. With a law issued in 1973, the Ministry of Economy is authorized to lower the interest rate also on bonds already subscribed, as has happened since 1986.

In that year the M, N, O and P series were equated to the series Q, which had lower interest rates than the previous ones. In this case, opening a dispute becomes difficult because the law protects Poste Italiane, which acted legitimately.

However, vouchers issued after July 1, 1986 may carry a different letter, although the company has to apply the new Q series. It could be written for example P / Q.

In addition, non-compliant administrative actions may have occurred, such as failure or incorrect application of the stamps and the indication of unfavorable interest rates with respect to the indicated series.

Often the stamp would only change a reference period, or the first 20 years and not the entire duration of the thirty-year vouchers, in other cases the stamp would not have been affixed, leaving the annuity prospectus on the voucher unchanged.

Upon expiry of the Poste Italiane vouchers, he would have paid only the amounts provided for by the rule applied since 1986, against savers who instead expected to collect how much indicated on interest-bearing bonds.

It is not uncommon for the financial banking Arbitrator to agree with the consumer in the event of an appeal, asking Poste Italiane to pay the difference in collection on the annuity of the voucher. However, the decisions of the APF are not binding, and savers have had to rely on the ordinary courts.

FederConsumatori has repeatedly urged the company and the State to intervene on the issue of postal savings bonds Q series, also to avoid the clogging of the courtrooms.

To take part in the class action promoted by the association, it is possible to verify that you have the requisites to participate in the action, therefore a “wrong” postal interest-bearing voucher, and have already collected the lower than expected annuity. In this case it will be necessary to pay € 50 to FederConsumatori for legal fees by registering on the site serieQ.it.
