On the night of last Saturday shortly after midnight there was a fatal traffic accident in Mayen, in which two men allegedly fought a car race on the Habsburgring and ran over a pedestrian and fatally injured him. What must the young men who probably caused the death of the fifty-year-old man on August 26 in Mayen expect? Aktuell4u interviewed our columnist and lawyer, Friedrich W. Dittmann from Mayen.

A4u: What could the alleged perpetrators face?

FWD: First of all, the driver’s license is gone, for at least 6 months, depending on the severity up to 5 years. In extreme cases, lifelong.

A4u: And what about a prison sentence?

FWD: The focus is on Section 315d of the Criminal Code, which deals with illegal street races and, according to more recent case law, also with individual races. That goes from a fine and a prison sentence up to 2 years. In the case of danger to life and limb, 5 years are possible.

A4u: Is there a murder charge?

FWD: That’s basically possible, because a car can be a murder weapon. But then it must be proven beyond a doubt that the death of a person was accepted with approval. That goes for life. As long as the perpetrator trusted that nothing would happen, he got away with negligent homicide and regularly up to five years in prison.
