The lawyer Raúl Caballero, legal advisor to the former liberal deputy Carlos Portillo, confirmed the presentation before the constitutional chamber of the Court, of an appeal of unconstitutionality against the resolution of the Chamber of Deputies that removed the investiture.
He questioned that this procedure took place in a marathon session and that it affects the structure of the republican principle, since the conduct that was considered to be the use of influence was not specified.
Neither do the two chambers have specific regulations to expel a member, he said.
The lawyer also stated that to remove a person from his bench there must be a criminal conviction. The lawyer even analyzes the possibility that the plenary session of the Court decides the action raised.
