Management Hotel Sultan by PT Indobuildco whose main director is Pontjo Sutowo has ended. Chairman of the Supervisory Board of the Bung Karno Gelora Complex Management Center (PPKGBK) Edward Omar Sharif Hiariej or Eddy Hiariej said that during 2007-2023 or 16 years of managing the Sultan Hotel, PT Indobuildco never paid royalties to the government.
“For the record, during the 2007-2023 period, PT Indobuildco did not pay royalties (contributions) to the state, in this case the Ministry of State Secretariat cq. The Management Center for the Bung Karno Sports Complex,” Eddy said at a press conference at the Ministry of State Secretariat, Central Jakarta, Friday ( 3/3/2023).
The Deputy Minister of Law and Human Rights explained that the management of the Sultan Hotel and the GBK area legally owned by the Ministry of State Secretariat (Kemensetneg). This management was strengthened in four Judicial Review (PK) decisions.
“Decision for Judicial Review of Civil Case Number 276PK/Pdt/2011 dated 23 November 2011 (PK 1) on a land dispute where Hotel Sultan located in Block 15 Management Rights (HPL) No. 1/Globalism of the Ministry of State Secretariat cq. PPK GBK has been declared final and binding,” he said.
Case Position
As quoted from the Decision of the South Jakarta District Court Number 952/Pdt.G/2006/PN.Jak-Sel, Indobuildco was given the task by the Regional Government of DKI Jakarta to build a Conference building in 1971. One of them was an international standard hotel which had to be completed in 1974. The aim was to serve as a place for PATA Conference. Indobuildco then get land management rights over 13 hectares of land.
Then issued HGB Certificate Number 26 with an area of 57,120 square meters and HGB Number 27 covering an area of 83,666 square meters. The HGB is valid for 30 years or expires in 2003.
On the other hand, the BPN issued a Decree concerning the Granting of Management Rights to the State Secretariat cq the Bung Karno Sports Arena Management Agency in 1989 which was contained in the Decree of the Head of the National Land Agency Number 169/HPL/BPN/1989. The decree includes HGB land numbers 26 and 27 which are managed by Indobuildco.
