POLICY – The People’s Force asks the JCE to declare Gonzalo’s candidacy inadmissible

The People’s Force (FP) requested that Gonzalo Castillo’s presidential candidacy be declared inadmissible by the Central Electoral Board (JCE) under the allegation that the Dominican Liberation Party (PLD) violated the Electoral Law (15-19) when starting a campaign at the wrong time.

Through an instance deposited by its political delegate to the JCE, Manuel Crespo, the FP argues that the commission is the institution responsible for enforcing the provision that prohibits the start of the campaign at the wrong time.

The opposition party alleges that the presidential candidate of the PLD carries out a profuse campaign to promote his aspirations before the JCE issues the proclamation through which the electoral campaign for said election level is left open

In this regard, he claimed that on January 13 of this year, in all print media of the country, such as electronic or digital, Gonzalo Castillo, through paid space, published a massive graphic propaganda in which he promotes his image

For these purposes, the FP deposited copies with the JCE of the media where it was published

The PLD

While the PLD denied the accusation and said that Castillo remains in the streets supporting local candidates.

He explains that the seventh publication that denounces the instance of the FP was made by a group of citizens in a private capacity, and that they should be part of an external support movement.

It understands that any applicable sanction that the JCE determines must be attached to the principle of proportionality so that the sanction is adapted to the level of seriousness of the possible infraction.

The PLD understands that the application for inadmissibility of the requested candidacy would be a totally disproportionate sanction, “which does not correspond to the level of severity of the possible infractions arising from the publications made

Other cases

The PLD warns that if it were decided to impose any sanction for such publications, the JCE would be obliged to sanction the presidential candidate Luis Abinader in the same way, for the publications he has made.

The instance

By means of an instance signed by his political delegate José Ramón Fadul and the secretary of Legal Affairs of the PLD, José Dantés Díaz, they affirm that there are no legal reasons for the JCE to adopt precautionary measures, impose sanctions of an electoral administrative nature and order the inadmissibility of the candidacy de Castillo for remotely starting his campaign before regulatory time.

When recognizing the sanctioning power of the JCE, Fadul and Dantés state that none of the facts alleged by the FP constitute violations of said laws, and no sanction proceeding.

Given the allegation of LP that it maintains a promotion in the streets and in the media, the PLD argues that it cannot be attributable to the candidate for demonstrations of support organized by individuals such as the specific fact of making paid publications in the media.

“We allow ourselves to clarify that all the political and campaign activities in which the presidential candidate of the PLD, Gonzalo Castillo, has participated and continues to participate, have been and are activities to promote municipal candidacies of the PLD and allied parties nationwide, corresponding to the electoral contest next February ”, says the instance with which he responded to the JCE.

They point out that Castillo has been supporting the municipal candidates of his party “in the same way that the presidential candidates of the Modern Revolutionary Party (PRM) and presidential candidates of other groups and movements have been doing. They also pledged to take “corrective measures to ensure that situations that tend to violate” legal provisions do not occur.
