Police Warn Against Blocking Public Roads: Maximum 15 Years in Prison

Dirkrimum Polda Metro Jaya Kombes Hengki Haryadi was furious with the community demonstration that blocked road traffic access Jatikarya toll road. Hengki said that this action caused a lot of harm to other communities.

“There are lots of complaints that someone has to go to the hospital, their child is sick and ends up being abandoned. Some are forced to go down the toll road,” Hengki told reporters at the location, Friday (14/4/2023).

Hengki said that expressing opinions in public is regulated in Law Number 9 of 1998. In these regulations, there are several regulations that must be obeyed by the masses, one of which is not to disturb public order. However, the action taken by the community by blocking the road clearly violated existing regulations.

“Delivering opinions in public is the right of every citizen. But they also have an obligation to respect the rights of others. What happened here, was not expressing opinions in public, because it was not in accordance with the law. What did the masses do here, It is an illegal act,” he said.

The former Head of Central Jakarta Metro Police warned residents or demonstrators to block roads Jatikarya toll road can be punished. Referring to Article 192 of the Criminal Code, demonstrations that obstruct public roads carry a maximum penalty of 15 years in prison.

Whosoever deliberately destroys, renders useless, or damages a work for public traffic, obstructs a public road, either a road on land or a road in water, or impedes an action taken for the safety of a work or a similar road it is punished:

1e. Imprisonment for life Nine years, if the act could endanger traffic safety;

2e. imprisonment for a maximum of fifteen years, if the said act can pose a danger to traffic safety and someone dies because of it. (KUHP 35, 165, 206, 336, 406, 408).

Will Call the Parties Involved

Hengki said that Kapolda Metro Jaya Inspector General Karyoto had instructed his staff to take firm action against residents who disturbed public order. Because, it is considered troubling many parties.

Hengki ordered his staff to secure the CCTV at the location and identify all parties involved. He asked that everything be checked on Monday (17/4) next week.

“CCTV took everything, who was the initiator who recommended this to be examined starting Monday, who was sitting here examined everything, violating the process law. The police already have intelligence data, there are names coming, calling everyone,” he said.

Hengki asked not to let similar incidents happen again. He emphasized that the steps taken by the police were in the interest of the wider community who felt disturbed by the actions of the people there.

“We are in order to protect broader interests. Once again if this group feels demanding for their rights, but may not take other people’s rights. I am like this first to respond to public unrest, society, this must not be repeated,” he concluded.
