Police search of Plovdiv nightclub deemed legally justified despite complaints of nudity

The police acted perfectly legally in the search of a nightclub in Plovdiv on Friday, even though some of the patrons complained that they were made to strip naked to be searched. This was announced on Monday by the Regional Directorate of the Ministry of Internal Affairs – Plovdiv. A day ago it became clear that nearly 400 people were searched.

From there, they admitted that some of the examinees were made to undress and assume strange positions, but specified that this was done in accordance with the requirements of the National Criminal Code. The law enforcement authorities motivated their inspection with the presence of operational data that there were drugs in the establishment. The method of search is determined by the police officers on the spot.

An internal abuse of authority reviewer has been assigned to each case.

“There have been statements, including in the media, by persons present that people were made to undress and take some strange positions. Indeed, there was such a check, but this check was carried out according to the requirements of the CPC and it in relation to specific persons for whom there was already operational data,” said senior commissioner Vasil Kostadinov, director of the ODMVR-Plovdiv.

After the action in the nightclub, three pre-trial proceedings were initiated – two for drugs and one for hooliganism. The owner of the club has appealed to the prosecutor’s office for exceeding the powers of the police officers.

“What was found was one cigarette of marijuana and some package of 0.4 grams of substance. Nothing more. We filed a report in the prosecutor’s office, because for us this is a humiliation to our clients and we cannot leave things like that. Another could have been found a way to check people”, says Deyan Naydenov, owner of the establishment.

The interior minister will check the action

Interior Minister Ivan Demerdzhiev also responded to calls for the resignation of the director of the police in Plovdiv, after the Bulgarian Association of Restaurants threatened protests if no one was punished in the case of the drug check in the club.

Interior Minister Ivan Demerdzhiev explained that he would first check the operation of the Plovdiv police and then comment. Asked if he would demand the resignation of police officers, he replied: “Before the investigation is over, I will not ask for anything, so wait for it to end,” he said, quoted by Nova TV.
