Police Officer on Trial: Witness Testimonies Expose Alleged Violence and Negligence in Kongsberg Case

BUSKERUD TINGRETT, KONGSBERG (Dagbladet): – I was really scared, he shouts that he can’t breathe. I heard from the voice that he was afraid. Then I became very worried, it was very disgusting.

This is what the victim Kevin Simensen’s girlfriend, Karoline Heia, says from the witness box.

On Friday, the last witnesses explain themselves in the case against the police officer who is accused of serious violence and grossly negligent breach of duty after the mission at Kongsberg on the night of 30 October 2022.

Argument over expert witness

He denies criminal guilt and believes that the use of force was necessary because of the resistance of one of the victims, Kevin Simensen (26).

Heia says that Simensen has “suffered a lot afterwards”, and has been troubled by nightmares and poor sleep.

– He suffered a concussion, has struggled with his memory, and had a lot of pain in his body.

– Can not believe it

The accused policeman has previously explained that Simensen put up strong resistance – despite repeated blows, both with fists and a baton, as well as pepper spray.

When asked what her boyfriend thinks about the incident today, eight months later, she says that trust in the police is “very weakened”.

– I was very shocked and disappointed by what I saw. I can’t believe that what happened actually happened, Heia continued.

Police witness: – The worst assignment

– Horrible

Heia explains that she did not perceive Simensen as aggressive or particularly irritated at first, before her boyfriend was knocked to the ground by the accused policeman.

A friend of the aggrieved also explained herself on Friday.

She says that she had to go into the petrol station and sit down towards the end of the incident.

– I think it was so cruel, what happened. At first I stood very far away, and did not see very clearly what was happening. (…) I was completely shocked by what was going on, she says from the witness box.

Testified about death threats

In the last two days, a number of police officers, who were present that evening, have given evidence in court.

None of them have been able to answer what was the reason for the defendant to put Simensen on the ground and then hit him repeatedly with a clenched fist and a baton.

However, they paint a picture that Simensen, on the evening in question, was both aggressive and threatening.

A security guard has said that he was threatened with death by the 26-year-old earlier in the evening – and that he fears revenge to this day.

Found knife and baton: – Not the intention

Confronted with findings

It has also emerged in court that Simensen had both a baton and a knife in his jacket that evening. The knife was never retrieved, but was found in the arrest later.

The baton was found on the ground by one of the police officers.

Simensen has acknowledged that both objects were in his jacket, but explained to the court that he did not intend to take them out on the town that night.

He also said he never intended to use the weapons.
