A policeman with a laceration and a refugee with a bruised chest and a nervous breakdown: these were the consequences of a deployment in a refugee accommodation in Bruck.
Fürstenfeldbruck – The district court has now dealt with what exactly happened. There was no judgment – but there was a penalty.
The asylum seeker, a 35-year-old Nigerian, sat in the dock. He was charged with assaulting and deliberately injuring the police officer who did not show up for the trial.
It was about September 4th last year. At that time the refugee had received an official request to leave the Bruck accommodation and move to Schrobenhausen. The next day the man was still there, which is why the property manager called the police for help.
Refugee did not want to go voluntarily
The policewoman who was on duty at the time with the colleague who was later injured now said that the refugee did not intend to leave the container voluntarily. He was “unreasonable and aggressive”. The two of them tried to lead the man out of the room, which didn’t work. Because: “He was physically superior to us.”
The judge then wanted to know why the two had not called reinforcements. “In the turmoil we didn’t think about it,” replied the policewoman. They threatened to use pepper spray and did so when the man approached them.
Punches
Then the asylum seeker opened the window of the room on the first floor of the container. The police officer said that she and her colleague were not sure that he might jump out. That is why her colleague approached the man. When the fugitive turned around, the policeman punched him several times. The Nigerian was brought to the ground, but he fought violently against the handcuffs. When he already had one on his left hand, he tore himself away and hit the police officer’s head with the metal. So it came to the laceration.
The fugitive came to the hospital – the police officers called for reinforcements after all. The transport was captured on video. In this way, an important matter could be clarified: a spit hood was put over the head of the defendant – and not, as his lawyer suspected, a sack. This hood prevents police officers from being spat on.
Overreacted?
The asylum seeker himself did not comment on the allegations. His defense lawyer, however, wanted clarification. He wondered: Was the police even lawful? In addition, he could not see that his client had threatened the police. And that, therefore, pepper spray had to be used and physical violence had to be exercised.
Since the policeman himself was summoned to the hearing, but was not present, his colleague spoke for him. She remembered that the retired police officer had asked her after the mission, whether he had overreacted that day.
This led the judge to the following conclusion: The colleague had self-critically questioned his behavior. And he emphasized that police officers also have to critically examine themselves again and again.
The judge then suggested ending the 35-year-old’s trial without a verdict. After consulting his lawyer, the accused was ready to do so. As soon as he has completed ten hours of work, his case is terminated.
