Plurality is necessary for democracy, says Coparmex

The Employers’ Confederation of the Mexican Republic (Coparmex) considered that the divided vote observed at the National Electoral Institute (INE) to assign proportional representation seats is “a clear example” for a comprehensive reading of the Constitution, which respects the will of the electorate.

After the General Council of the INE granted the qualified majority to Morena, PVEM and PT in the Chamber of Deputies, the private sector organization indicated that what happened opens a debate on the interpretation of the Magna Carta regarding overrepresentation.

Coparmex considered that the discussion at the institute underlines “the importance of plurality and strengthening the democratic life of the country.”

“Diversity of opinion is essential to ensure that our institutions operate in a fair and representative manner,” he said.

Coparmex urged the Electoral Tribunal of the Judicial Branch of the Federation (TEPJF) to ensure that the will of the citizens is faithfully reflected in the composition of Congress, respecting the percentages of proportional representation and guaranteeing compliance with Article 54 of the Constitution.

He considered that “it is necessary to equate the figure of a party with that of a coalition, as is done in other interpretations of the constitutional norm, so that no political force would have more than 300 seats or more than 8 percent of representation.”

He insisted that any constitutional change “be the result of consensus among all political forces and not of an overwhelming majority.”

“The right to promote unconstitutionality actions is crucial, guaranteeing that an opposition that reaches 33 percent can present such actions, avoiding a regression towards a hegemonic political model, such as the one experienced in Mexico in the 1970s,” he added.

He concluded that it is now up to the TEPJF to continue this reflection and “assume its historical responsibility.”

I would like to point out that the judges should not stick to a formula, but should carry out an analysis that goes beyond the technical and delves into the legal, political and ethical aspects that ensure a fair interpretation of the constitutional framework.

“We urge the TEPJF to respect the will of the citizens expressed at the polls in its decision and to ensure that any overrepresentation does not distort the democratic balance,” he said.
