Plenary session of Congress approves a rule that eliminates the commission for bank transfers and credit card payments

Prior to the vote, legislator José Cueto Aservi (RP) raised a preliminary question so that the text could be referred to the Economy, Banking, Finance and Financial Intelligence Commission, a proposal that was rejected with 47 votes in favor and 49 in favor. against.

The Plenary Session of Congress, this Thursday, April 18, will issue a ruling that protects consumers of financial services from usury, in order to eliminate the commission for bank transfers and credit card payments.

The text incorporates the sixth final complementary provision in Law 31143, in the following terms:

“In the savings account contract and the current account contract, the commission is not charged for bank transfers to another or from another banking entity in the financial system.”

Likewise, it establishes that in the credit card contract, the collection of the commission for credit card payment through a financial institution or a third party other than the company with which the product was contracted is not applicable, with the exception of the credit card payment through a rural savings and credit bank, municipal savings and credit bank, municipal popular credit bank or savings and credit cooperative.

For his part, the president of the Commission for Consumer Defense and Regulatory Bodies of Public Services, Wilson Soto Palacios (AP), maintained that what is sought is to eliminate the costs that consumers assume today for transferring their own money to through financial institutions and paying their credit cards.

“The commission considers that it is necessary to complement the current regulations, to guarantee their due compliance by the Superintendence of Banking and Insurance and for the benefit and protection of consumers,” he said.

At another point in the debate, parliamentarians Sigrid Bazán Narro (CD-JP), Óscar Zea Choquechambi (BM), Guido Bellido Ugarte (PB), María Agüero Gutiérrez (PL) supported the proposal, considering it necessary to take measures to protect all Peruvians.

“It is false that this initiative will discourage entry into the financial system. Reducing these costs will mean that people can pay with peace of mind, having their money in their accounts and without moving from one place to another,” said Bazán.

However, congressmen Alejandro Cavero Alva, (Avanza País), Carlos Anderson Ramírez (NoA), Rosangella Barbarán Reyes (FP), Eduardo Salhuana Cavides (APP), were critical when referring to the proposal, warning that it could have consequences for the financial inclusion of Peruvians and for their security.
