“The excessive preoccupation with the personality of the accused is disorienting, as instead of the court investigating the acts and omissions of the medical staff, which are connected to the evolution of Georgina’s health, it investigates the personal life of the accused which is not causally connected to the death of Georgina ” said the lawyer of Roula Pispirigou, Alexis Kougias, in his plea, which began today before the Mixed Jury Court.
Mr. Kougias, in his position on the charges of attempted and murder against the first-born daughter of his principal, spoke of prejudice against Pispirigou, while he was successful against the entire long-term process that has preceded, saying that “if something was murdered in this process, this is the scientific truth and the right reason”.
In his plea, the 35-year-old’s lawyer did not leave out of the frame, neither the District Attorney, who has requested Pispirigou’s guilt, nor the Professor of Forensic Science and Toxicology of the AUTH Nikolaos Raikos, who signs the toxicology report in which a large amount of ketamine is found in Georgina’s blood, but neither Georgina’s father.
According to the advocate, the prosecutor’s starting point is not the search for the objective truth, but “the preliminary admission of guilt due to prejudice. Commenting on the prosecutor’s motion, Mr. Kougias referred to “tiresome invocation of the emotions of the members of the court” with “formulations of holy indignation” and the aim “to cloud your objective judgment and the clarity of your thinking” as he said addressing the court.
“Prejudice against the accused”
In contrast to the prejudice with which his principal is treated, Mr. Kougias placed the “deification of Manos Daskalakis” saying that “For some inexplicable reason, everything the accused did was considered formal, cold, indifferent and procedural, while the fact that a time Manos Daskalakis came and put some oil on Georgina’s forehead in the hospital of Rio, it was considered a supreme and incomparable proof of parental love. No matter what the accused did for Georgina, she could never overcome Manus’ “oil”. This shows how deeply critical thinking and reason have been corrupted by prejudice against the accused.”
For Mr. Raikou’s toxicological examination report, the advocate asked “to throw it in the wastebasket”, stressing that from the beginning the disputed report was considered “certain” and “an inviolable sacred text”. As Mr. Kougias mentioned, if the report is removed “then there is no other evidence to indicate criminal activity and that cannot be substituted, nor can it be substituted with gossip.”
According to Mr. Kuya, “Raiku’s aim was to rise scientifically through this case, to become the ‘king of toxicologists’ by being recorded in the world toxicological annals as the toxicologist who managed to identify the first ever child death from ketamine in a hospital by a parent’s act and not by a medical error”.
Alexis Kougias noted that there is no trace of the ketamine from its source to its destination, while he added that it is certain that the resuscitation kit, which the medical team took after Georgina’s fatal stop, contained ketamine and midazolam.
“Also, you have the fact that ketamine and midazolam are substances that complement each other in the context of the protocol for the application of intubation” he emphasized.
He stated, in fact, that if instead of the two substances we put a deadly weapon in the case, “the court’s decision would easily be in favor of the conviction of those who brought the crime weapon into the victim’s room. No court would accept that the person who brought the crime weapon to the crime scene did not use it because someone else coincidentally brought the same weapon to the same place and time and used it shortly before, but it was not found.
So why in this particular case should we accept that by diabolical coincidence on the same day and in the same place ketamine-midazolam was brought to Georgina’s room by both the accused and the resuscitation team, but the ketamine-midazolam was administered by the accused and not by recovery team?’
Mr. Kouya’s trial will continue on February 21.
