The Sejm adopted an amendment to the act on renewable energy sources (RES), which introduces a new billing system for photovoltaics and prosumers. According to it, prosumers will sell the surplus energy put into the grid at a certain price, and they will pay for the energy consumed like other consumers.

Jadwiga Emilewicz on Thursday announced the withdrawal of the project concerning changes in the regulations for the settlement of photovoltaics and prosumers, on which the committee for energy, climate and state assets worked. On the same day, however, the committee dealt with a new draft amendment to the regulations in this matter. The representatives of the applicants was MP Marek Suski, head of the energy committee.

Photovoltaics – new rules adopted by the Sejm
On Friday, 225 MPs voted in favor, 212 were against, and one MP abstained. Earlier, the Sejm rejected the motion submitted by the KO club to reject the bill in its entirety. The bill will now go to the Senate.

Pursuant to the new regulation, the new system – net billing – will apply from April 1, 2022. All those who will become prosumers by the effective date of the act will be billed according to the current rules – in the discount system – for 15 years.

A prosumer is a person who generates electricity from renewable energy sources for his own needs using micro-installations, and at the same time can store it and transfer the surplus to the power grid.

New prosumer billing system
Net billing predicts that prosumers will sell surplus energy fed into the grid, and will pay for the consumed energy just like other electricity consumers. They will also incur distribution fees, from 15 percent. discount on distribution variable charges for energy fed into the grid and stored there by persons and entities that are not entrepreneurs.

Settlement in the net billing system is to take place within 12 months. The prosumer will have a deposit – a register of funds kept on a monthly basis and will be able to pay for the consumed energy from there. The value of the energy deposited in the deposit is to be calculated for the time being on the basis of the monthly average price. The prosumer is not to pay VAT or PIT on the energy fed into the grid. However, by drawing energy from the grid, it will partially pay distribution fees, RES and cogeneration fees, as well as excise duty and VAT.

Photovoltaics and energy production for own needs
Today, prosumers producing energy in installations up to 10 kWp pay a fee of 1 to 0.8. For one unit of energy fed into the grid, they can download 0.8 for free. For larger installations (above 10 kWp) this ratio is 1 to 0.7. It is a net metering system that uses the discount mechanism. Settlements are made in semi-annual periods. Prosumers do not pay part of the distribution fees for using the network.
