Philips TVs can stream again in 1080p, but 4k is only possible after firmware update – Image and sound – News

The information provided by the consumer association is fairly crooked.

In reality, the law in the Netherlands prescribes that the seller is and remains continuously responsible for the delivery of a reliable product.

In the event of a defect, the question is therefore always what the defect is the result of.

For example, if it is the result of the expected wear and tear during a normal usage pattern, then the delivered product can simply be called sound. It has then performed in accordance with the expectations that you as a consumer should have of it. In that situation you are in principle not entitled to a completely free recovery. And you will have to work with the seller to work it out.

A common example of this is a leak in a pre-loading washing machine due to a worn cuff. In many cases this is just normal expected wear and tear and does not fall under free repair.

It will be different if it concerns a defect due to inadequacy. The product then performs not in accordance with the expectations that you as a consumer should have of that product. In such a case you have always right to free repair, regardless of the expired term.

This situation with the Widevine DRM and revoked keys is an example of this. This problem is the result of a security leak and thus a demonstrable flaw or lack of the software or hardware design.

The above also means that if a product has a normal wear pattern where it is worn out within 2 years, you would not be entitled to free repair. However, that is where EU directives come into play. These state that you must have a right to recovery for at least 2 years, and that individual member states may extend this period. So a lower limit has been added in our legislation for this. (Incidentally, there is of course an exception for perishable goods, etc.)
