Accusation of perverting the course of justice

According to the Erfurt judges, the defendant had made a judgment that he had intended from the outset and for which he had actively brought about the proceedings. This constituted the criminal offense of perverting the course of justice – and in a particularly serious manner, according to the regional court in August 2023 in its reasons for the judgment.

Among other things, the district judge had tried to cover up the fact that he had been directly involved in the preparation of the relevant court proceedings regarding the mask requirement. According to the regional court, weeks before his decision he had worked to find a family for whose children he could conduct child protection proceedings. He was sentenced to a suspended sentence of two years for perverting the course of justice. Both the defendant and the public prosecutor’s office appealed against this. It is still unclear when the Federal Court of Justice will decide in the case.
