Coordinating Minister of Policy, Law and Security (Menkopolhukam) Mahfud Md respond to articles considered controversial in new penal codeone of which is the element of demand about adultery.
According to Mahfud, many people criticize but have not read carefully the articles of the new penal code. So there is a misunderstanding.
“Because sometimes the people who criticize sometimes haven’t even read it. They say, ‘Foreigners don’t go to Indonesia, and then if you have sex with someone who isn’t your wife or husband you could go to jail.’ You haven’t read the law yet,” Mahfud said during the Year-End Notes for the Coordinating Minister for Political, Legal and Security Affairs, at the Coordinating Ministry for Political, Legal and Security Affairs, Jl Medan Merdeka Barat, Central Jakarta, Thursday (15/12/2022).
Mahfud explained that in this article a person could be subject to criminal penalties if the husband or wife and family are reported for committing adultery. Mahfud mentioned the moral in the article to urge people not to commit adultery. That is, the adultery article is a denunciation crime article.
“Although the law only threatens punishment if his wife, or her husband, who commits adultery, or her son, or her father, complains. Oh, foreigners don’t bring their wives here. mountain where is it? Don’t bring up children, whoever complains, the father already dead, who wants mountain,” he said.
“And the most important thing is not a question of who wants complaint Yes, you shouldn’t commit adultery. This is the moral appeal of the book of laws. But many have not read it,” she explained.
For your information, the new penal code was approved by the DPR on Tuesday (6/12) and will be valid for another three years. DPR Vice-President Sufmi Dasco Ahmad believes that more socialization is needed regarding this new penal code. The problem is that many people have misunderstood what happened to the articles on adultery and cohabitation.
“For tourists, do you want their families to report here? That’s all approximately,” Dasco said at the DPR building, Senayan, Jakarta on Thursday (12/8).

Article 411 (on adultery or free sex)
1. Whoever has relations with a person who is not the husband or wife is convicted of adultery, with the maximum imprisonment of 1 (one) year or with the maximum fine of category II.
2. Proceedings are not made against the crime referred to in paragraph 1, except for complaints:
– husband or wife for people related by marriage.
– Parents or children for people not related by marriage.
3. The provisions of articles 25, 26 and 30 do not apply to the complaints referred to in paragraph 2.
4. Complaints may be withdrawn until the examination before the judge has begun.
Art. 412 (in matters of cohabitation or cohabitation)
1. Anyone who lives outside marriage is punished with imprisonment up to a maximum of 6 (six) months or with the maximum fine of II category.
Against the Crime referred to in paragraph 1, only a lawsuit shall be filed:
– Husband or wife for people related by marriage; or
– Parents or children for people not related by marriage.
2. The provisions of articles 25, 26 and 30 do not apply to the complaints referred to in paragraph (2).
3. Complaints may be withdrawn until the examination before the judge has begun.
