Pence “I have no right to reverse the results”… Request for dismissal of lawsuit against election

U.S. Vice President Mike Pence asked the federal court on the 31st of last month (local time) to dismiss the lawsuit, claiming that he did not have the authority to overturn the vote of the electoral vote, which was found to have won Joe Biden.

According to US media such as USA Today, Vice President Pence told the Texas federal court that day, “I am not the appropriate defendant in this case.”

Earlier, Republican Congressman Louis Gomert filed a lawsuit against Pence regarding the Electoral Count Act enacted in 1887, with the Vice President as the defendant, saying that a lot of discretion should be guaranteed in the process of certifying the electoral corps.

It was a lawsuit in the sense that Vice President Pence should have the right to decide if the outcome of the vote, in which the results of the vote between President Donald Trump and President-elect Biden were mixed, were presented at a joint Senate and House meeting on January 6. He stated that in order for the lawsuit to be established, the interests of the plaintiff and the defendant must conflict, and that he cannot become the defendant in this lawsuit. He explained that the proper defendant in the lawsuit should not be himself, but the Congress that passed the bill. The meeting of the House of Representatives after the electoral vote is actually just a formal procedure in which the elected person is decided. However, the pro-Trump forces in the Republican Party filed this lawsuit, saying that they had to give the vice-president the right to decide on electoral votes to overturn the election results. However, Vice President Pence’s side was beaten. He insisted that the lawsuit should be dismissed, saying, “Considering the time remaining until the elections are certified, there is not enough time to deal with difficult constitutional issues.”

The Texas federal court demanded that the plaintiffs settle their position on Vice President Pence’s request by the first day. Since then, the hearing schedule has not been disclosed.
