The antenna on the roof goes without saying. Its assembly seems to be a simple activity and is not associated with problems. It turns out that this is only an illusion, and in the event of breaking the rules, you can pay up to PLN 2,500 fine.

Building a house is a really complex process, during which many unexpected risks await investors. Construction law is quite restrictive and it is easy to make a mistake unknowingly, which can turn out to be really costly. It is no different for people who already live in the house but want to make some modifications. An example of such a situation is mounting the antenna on the roof.

The installation of the antenna to receive a TV signal on the roof does not require a building permit. Pursuant to Art. 29 sec. 2 point 15 of pr. build. – does not require a building permit decision to perform works involving the installation of devices, including antenna supporting structures and radio communication installations, on building structures.

Penalty for mounting the antenna. When can you get it
However, in some cases, mounting the antenna on the roof may result in a penalty. This applies to a situation where the antenna is mounted on a mast higher than 3 meters. According to Art. 30 sec. 1 point 3 lit. pr. build. performance of construction works involving the installation of devices with a height of more than 3 meters on construction objects requires notification to the competent architectural and construction administration authority.

As we read on the website praw.pl, the competent authority may order the demolition of the resulting object if it was built without notification or despite objections raised by the authority (Article 49b (1) of the Act of July 7, 1994 – Construction Law (consolidated text: Journal of Laws of 2013, item 1409).

The situation where the antenna is mounted at a height of more than 3 meters does not happen very often. This mainly applies to places where it is difficult to obtain optimal signal quality due to the topography or the density of buildings. However, it is important to follow the rules to avoid being punished.

The regulations provide for a high penalty for breaking the above-mentioned regulations. If the structure is not notified to the competent authorities, the owner of the building may expect to pay a legalization fee in the amount of PLN 2,500.
