A 42-year-old man lost his life on Friday February 4, 2022, around 9:30 p.m., after being run over by a motorist on the boulevard Leningradto Havre (Seine Maritime). To initiate proceedings on the count of manslaughter, a fault of recklessness, negligence or a breach of the obligations of the highway code at the origin of the accident must be committed by the motorist.
Under narcotics
However, the first elements of the investigation (still in progress), indicate that the pedestrian had entered when the light was red for him. But we also know that the motorist, aged 25, was driving under the influence of narcotics: “It does not seem that this is the direct cause of the accident”, indicates the public prosecutor of Le Havre Bruno Dieudonné.
Also, during the tragedy, stationary vehicles were in the first two rows when the car in question arrived launched, passing the green light “without seeing that this pedestrian was crossing”, as explained by the public prosecutor of Le Havre.
Crouched just before impact
On the other hand, a point concerning the materiality of the shock challenges the investigators. According to the videos that could be used, it seems that the pedestrian was more or less crouched just before the impact. “We don’t know if he wanted to avoid the car by getting on the ground, we don’t really understand, confides Bruno Dieudonné. A car expertise is underway to try to determine the exact circumstances of the accident, but a priori, the motorist had little chance of avoiding it.
Of course, the prosecutor recalls that all these elements are to be taken with a grain of salt as long as the result of the expertise aimed at reconstructing the circumstances of the accident will not be known.
